Terms and conditions for Do College Better Standard Membership (12 Months)
Membership Agreement:
This agreement is for the purchase of the 12-month membership with Do College Better. You will be billed on the start/sign-up date and each subsequent month (on or around every 30 days after sign up date) for 12 (twelve) months beginning on the sign-up date for $14.95 per month plus applicable taxes until you cancel in accordance with this agreement. Your Monthly Membership Fee is guaranteed so long as you remain a member in good standing including payment of all monthly dues and services provided by Do College Better. You are authorizing us to charge any amounts you may owe, including but not limited to any membership-related obligations, service-based transactions, and/or online purchases to the form of payment with which you have provided us. The form of payment you have provided will remain on file until such time as you revoke your authorization for that form of payment through the Do College Better Cancellation Form or provide a substitute form of payment. A two month pause (for June & July only) is available for 6-month and 12-month memberships. It must be requested by emailing myinfo@docollegebetter.com.
Payment:
By checking the box to this agreement, I authorize College Campus Concierge, Inc. (hereinafter “Do College Better”) to initiate transactions from the debit or credit card provided to Do College Better for the purpose of billing the recurring Monthly Membership Fee I owe to Do College Better each month until all of my obligations are paid under this agreement or until my membership is terminated or cancelled. I understand that my obligation under this agreement includes my Monthly Membership Fee, charges for any and all services provided by Do College Better, applicable taxes, charges and any other unpaid fees or dues including past unpaid dues and fees. A $10 service fee will be applied for each month your Monthly Membership Fee is returned uncollectible for reasons including, but not limited to, non-sufficient funds, expired credit cards, canceled credit cards, overdrafts, and closed accounts. This authorization will remain in full force and effect during the term of this membership agreement. I understand that the amounts debited from my account may vary each month based on unpaid past dues and recurring fees, etc. I confirm that I am an authorized user under the terms of the applicable agreement with my financial institutions to use the payment method(s) that I have provided for the purchases of goods and services from Do College Better and agree to comply with my financial institution’s agreement at all times this authorization is in effect.
Rules & Regulations:
I agree to follow the Do College Better membership policies and business rules. Do College Better may, in its sole discretion, modify the policies and any business rule without notice at any time. Do College Better rules can vary by location and all signs posted in a location or on the premises or verbal communication shall be considered a part of the rules of Do College Better. Do College Better reserves the right, in its sole discretion, to terminate your membership immediately for violation of any membership policy or business rule.
Do College Better reserves the right at any time to delete, discontinue, or replace the services provided without any effect on this agreement. Do College Better also reserves the right to make changes to the type or quantity of services offered and to alter the hours of operation in Do College Better discretion. I acknowledge that the services provided by Do College Better are subject to demand and are offered on a “first come first serve basis”. Do College Better regularly closes on a temporary basis for selected holidays, inclement weather, etc. and such temporary closures will have no effect on this agreement so long as such temporary closures are reasonable. If Do College Better is permanently closed, moved or sold, Do College Better reserves the right to assign and transfer your membership.
I am responsible for notifying Do College Better of any error that appears on my bank or credit card statement in a timely manner. I must notify Do College Better within 60 days of a claimed error on my bank statement or credit card statement. If I claim my monthly dues were not stopped when I told Do College Better, I must have written proof (completed Do College Better Cancellation Form) or Do College Better will not reimburse me for any deductions which I claim should not have been deducted.
Do College Better has the right to add any tax imposed by the government to your prepaid or monthly dues. Do College Better also has the right to add any utility charges or surcharges to your prepaid dues and monthly dues with a notice via email, in writing, or signage at Do College Better.
Release of Liability
Liability to Client: I understand and expressly agree that my use of this Do College Better facility, or any other Do College Better facility, involves the risk of injury to me, whether caused by me or not. I understand that these risks can range from minor injuries to major injuries including death. In consideration of my participation in the activities and use of the facilities or services offered by Do College Better, I understand and voluntarily accept full responsibility on my behalf and for the risk of injury or loss arising out of or related to my use of the facilities or services. I further agree that Do College Better, its affiliated companies and their respective managers, employees, members, and independent contractors (collectively “Do College Better”) will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, disability, death, economic loss or any damage to me, my spouse or domestic partner, guests, unborn child, heirs, or relatives resulting from the negligent conduct or omission of Do College Better or anyone acting on Do College Better behalf whether related to services provided or not. Accordingly, to the fullest extent permitted by law, I do hereby forever release, waive and discharge Do College Better from any and all claims, demands, injuries, damages, actions or causes of action against Do College Better. I understand my right to not sign this agreement if there are any unfilled blanks and my right of cancellation and the billing and refund policies. I understand this release of liability and assumption of risk agreement and I have been given the opportunity to ask questions related to my use of the facilities and services provided. I further agree to comply with Do College Better membership policies and business rules that may be communicated to me from time to time either in writing, through signage or verbally. Do College Better may, in its sole discretion, modify the policies and any business rule without notice at any time. Do College Better reserves the right to refund the pro-rated cost of unused services and terminate my membership immediately for violation of any membership policy, business rule, or cultural violation.
Do College Better and the signee agrees that by signing this agreement, you purchased a membership and tutoring package(s) and agree to all the terms in this agreement. “Do College Better” include heirs, estates, agents, representatives, officers, directors, shareholders, successors, affiliates, subsidiaries, employees, and contractors. The signee and Do College Better make this agreement on behalf of, and it binds all these included persons and entities.
Liability for Property: Do College Better is not liable to you for any personal property that is damaged, lost, or stolen while on or around the Do College Better premises including, but not limited to, a vehicle or its contents or any property left in the study space. If you cause any damage to the Do College Better facilities, you are liable to Do College Better for its cost of repair or replacement.
Entire Agreement & Enforcement: You acknowledge that neither Do College Better, nor anyone else, made any representations or promises upon which you relied that are not stated in this agreement. This document contains the entire agreement between you and Do College Better and replaces any oral or other written agreement. If a court declares any part of this agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Do College Better does not enforce any right in this agreement for any reason, Do College Better does not waive its right to enforce it later. This agreement and all digital or scanned copies hereof will be deemed to be valid and authentic and you intend and agree that such electronic copies will be given the same legal effect as this original written and signed paper writing.
Membership: Your membership permits you to use Do College Better facility, discounted tutoring rates, and other services. The dues are for such access whether you use the facilities and/or purchase tutoring packages or not. Your membership is subject to all current company policies and rules and limitations. Your membership gives you no rights in Do College Better, its management, property or operation. You have no right to assign your membership or this agreement. Do College Better can sell memberships at different rates and terms than yours. Any special promotional membership or rate regarding privileges, usage, hours, benefits or facilities is valid only at the one location in question unless otherwise noted. Your membership can be frozen for verified medical reasons and must be done at the time of illness, injury or medical condition. Your freeze will be limited to the time indicated by your physician up to a maximum of 3 months. Your monthly dues will be automatically reinstated at the end of your freeze and billed to the debit/credit card on file with Do College Better unless you cancel your membership or you are approved for a longer freeze.
Cancellation: If you wish to cancel this contract, you may cancel by filling out the Do College Better Cancellation Form and turning in a hard copy in person to Do College Better staff. This can be completed at 240 N Block Ave, Suite B, Fayetteville, 72701. If your monthly membership has a minimum term, and you wish to cancel your membership early for reasons other than those listed in this agreement, a buyout fee equal to half of the amount owed on the remaining portion of the contract is required with your cancellation.
If you cancel your membership within 3 days of sign up, you may receive a full refund of all payments. If during the initial 3 days, you purchase a tutoring package at a discounted membership rates, you will be required to pay the difference in cost of a membership tutoring package and a regularly priced tutoring package.
In addition to the 50% buyout amount for canceling your membership, you must pay the difference of any remaining hours left on your membership tutoring package that was purchased at discounted rates and the amount of those tutoring hours at the non-membership tutoring package rates.
Do College Better will refund the remaining balance of the contract if: (1) You are unable to receive benefits from Do College Better by reason of death or permanent disability resulting in your inability to use a substantial portion of Do College Better services for 60 or more consecutive days. Do College Better may require that the disability is confirmed by an examination of a physician agreeable to you and Do College Better; provided, however, that this subparagraph shall not operate to prevent you from proving the disability in a judicial proceeding; or (2) Do College Better closes or relocates your location more than 20 miles from its present location, or the services provided by Do College Better are materially impaired.
IN WITNESS WHEREOF, the parties hereto, intending to be legally bound hereby, have duly executed and delivered this Agreement in duplicate, effective as of the date hereof.
